Court Denies Bail To Ardee City’s Builder
GURUGRAM: On Monday, the city court rejected the anticipatory bail application by the director of Ardee City’s builder in land fraud cases. Ardee City’s builder was accused of forging documents to get a licence for around 40 acres of land owned by the Haryana Shehri Vikas Pradhikaran and not developing the land reserved for EWS (Economically Weaker Section) plots in setor 57, Gurugram.
Refusing the application of Housing director Shibani Verma Kapur and Gopal Das Estates. The additional sessions judge Jasbir Singh observed that the demand was serious and taking such misdeed easy would be an injustice.
Economically Weaker Section
The judge said taking these types of offences and allegations normally, neglecting such cases, and releasing them on prospective bail is nothing but injustice and fraud to the hard-working, honest, Economically Weaker Section of Society. Also, the court said nowadays, property fraud by builders or developers has become common.
The judge said, now a day, these types of property frauds by powerful builders have become a daily task, and this will badly impact Society. The procedure in the case suggests deft execution and meticulous planning cheat the Economically Weaker Section of Society.
Directorate Of Town and Country Planning
Even in September 2021, Gurugram police registered two FIRs against the builder and its senior officials. The FIRs were registered for apparently forging documents to get the licence for the plot from the DTCP (directorate of town and country planning) by the builders and senior officials.
Also, in 2015, the DTCP learned about the alleged fraud against the builder when the builder applied to revise Ardee City’s layout. The authority had written to the revenue department and the Haryana Shahari Vikas Pradhikaran (HSVP) for the status of the land. But the authority discovered that the land on which EWS plots were to be constructed in Sector 57, Gurugram, was not even owned by the Ardee City’s builder.
Due to these reasons, the authority cancelled the licence and filed a second complaint against Housing director Shibani Verma Kapur and Gopal Das Estates in 2021.

Shibani Verma Kapur said that the FIR was registered due to vested interests. She said, I was not responsible for acquire any licence for Ardee City. I was neither the director nor the employee of the company and not holding any position in the company in 2002. Custodial questions are not required because the entire case is based on documentary evidence.
